How Estate Planning Is Like Baking | Cooper, Adel & Associates

?

Issue One of the Domestic Estate Planning Series by Melissa Reynard

?

Ok, so some of you may be wondering how on earth frosting a bunch of cupcakes is anything at all like Estate Planning.? And some of you would be right, there are some differences, but there are a lot of similarities as well.

?

Estate Planning, like Baking, involves multiple ingredients, no person?s ?recipe? is the same, and it?s often wise to refer to your cookbook?..er??I mean Elder Law Specialist when attempting anything complicated or for that matter easy.? After all, have you ever put that wonderful looking cake batter in the oven, only to have it fall as soon as it comes out?? Do you lament the wide cracks that appear in your bread? ? These issues are small when faced with the perils of not planning your estate and throwing ?ingredients? every which way, hoping for the best.

?

So let?s talk about ingredients.? When most people think of estate planning, they think of a will, maybe a trust, and not a whole lot else.? Sure, there are wills, and trusts, but you should also plan for other things, like Healthcare decisions and Powers of Attorney.? ? How could a catastrophic illness like a stroke play into your plan?? Your bank accounts, IRA?s, Insurance, and other policies likewise all have a place in your estate planning. ?

?

Each person is going to need different things from their estate planning as well.? There is no one size fits all to these types of things.? Some may have property and farmland they want to consider while other people live in an apartment but have invested heavily their whole lives.? Incomes are different, assets are different;? and as you well know, that recipe for the brownies you got at that party, tastes nothing like your last batch of brownies you made from another recipe.

?

So who?s to help you with your estate planning?? An Elder Law Specialist.? Just like a baker has their trusty cookbook, an Elder Law Specialist specializes in just that, estate planning!? They can help you develop a will or trust, advise on important documents, and give ideas for your financial accounts.? The offices of Cooper, Adel and Associates offer seminars to give you a better idea on what we can do for you, and while it may not be as fun as a cooking class, it?s definitely just as informative.

Arctic-sea oil exploration stands to open new frontier

By JOHN M. BRODER and CLIFFORD KRAUSS

POSTED: 01:30 a.m. HST, May 24, 2012

WASHINGTON >> Shortly before Thanksgiving in 2010, the leaders of the commission President Barack Obama had appointed to investigate the Deepwater Horizon oil spill in the Gulf of Mexico sat down in the Oval Office to brief him.

After listening to their findings about the BP accident and the safety of deepwater drilling, the president abruptly changed the subject.

?Where are you coming out on the offshore Arctic?? he asked.

William K. Reilly, a former chief of the Environmental Protection Agency and a commission co-chairman, was startled, as was Carol M. Browner, the president?s top adviser at the time on energy and climate change. Although a proposal by Shell to drill in the Arctic had been a source of dissension, it was not a major focus of the panel?s work.

?It?s not deep water, right?? the president said, noting that Shell?s proposal involved low-pressure wells in 150 feet of water, nothing like BP?s 5,000-foot high-pressure well that blew out in the gulf.

?What that told me,? Reilly later recounted, ?was that the president had already gotten deeply into this issue and was prepared to go forward.?

Barring a successful last-minute legal challenge by environmental groups, Shell will begin drilling test wells off the coast of northern Alaska in July, opening a new frontier in domestic oil exploration and accelerating a global rush to tap the untold resources beneath the frozen ocean. It is a moment of major promise and considerable danger.

Industry experts and national security officials view the Alaskan Arctic as the last great domestic oil prospect, one that over time could bring the country a giant step closer to cutting its dependence on foreign oil. But many Alaska Natives and environmental advocates say drilling threatens wildlife and pristine shorelines, and perpetuates the nation?s reliance on dirty fossil fuels.

In blessing Shell?s move into the Arctic, Obama continues his efforts to balance business and environmental interests, seemingly project by project. He pleased environmentalists by delaying the Keystone XL pipeline from Canada and by adopting tough air standards for power plants, yet he has also delighted business concerns by rejecting an ozone standard deemed too costly to the economy.

And now, the president is writing a new chapter in the nation?s unfolding energy transformation, in this case to the benefit of fossil fuel producers.

?We never would have expected a Democratic president ? let alone one seeking to be ?transformative? ? to open up the Arctic Ocean for drilling,? said Michael Brune, executive director of the Sierra Club.

Shell?s Arctic quest has consumed seven years and $4 billion over two presidential administrations.

Other oil companies are already lining up to join Shell in the Arctic, which company executives say could eventually yield a million barrels a day of crude ? or more than 10 percent of current domestic output. Among the Inupiat who live closest to the proposed drilling, the project continues to generate tension and debate. Although they depend on oil production for jobs and tax revenue, they rely on the ocean for much of their food and culture.

?I?m worried because we live off the ocean, the bowhead whale, the beluga, the walrus, the bearded seal,? said Tommy Olemaun, president of the Native Village of Barrow, an Eskimo tribal organization. ?The ocean is our garden.?

The natural world holds a mystical grip on the nearly 5,000 Eskimos of the North Slope, where the migration patterns of the bowhead whale dictate the rhythm of life. All other activity stops when the Inupiat load up their sealskin boats with gun-fired harpoons. Whale meat is carved at the beach and shared among the community along with mythical tales of whales giving up their freedom to nourish the people.

Bow-shaped whale skulls are displayed in front of public buildings, and baleens ? the bristly plates that filter krill in the whale?s mouth ? as trophies in offices and homes.

In early April, Roy Nageak, 60, a whaling captain, got off his snowmobile and climbed a high ice ridge four miles offshore in search of a navigable hunting trail. ?Those oil guys can think whatever they want, but we know how harsh this ocean is,? he said. ?They don?t know what they are getting into.?

But the Eskimos have also come to rely on the oil industry. Before onshore drilling began in the 1960s, many North Slope communities lacked running water and relied on kerosene lanterns for light. Residents chopped ice on nearby lakes and transported it by dog sled to preserve their food. There were no high schools or fire stations.

Since the construction of the Trans-Alaska Pipeline in the late 1970s, the North Slope has produced as much as one-fifth of the nation?s oil, and taxes on the industry finance the North Slope Borough government?s $350 million annual budget. Over the past 50 years, nearly all of Alaska?s prosperity has been driven by oil production and crude prices. Residents pay no state income tax, and in fact receive checks ? totaling roughly $5,000 for a family of four last year ? from the Alaska Permanent Fund, a corporation largely financed by oil revenues.

But the Exxon Valdez disaster in 1989 had changed attitudes, especially among villagers. They feared that drilling would disturb the bowhead migration, forcing the whales away from their food and their pursuers dangerously far offshore. They also feared a spill could poison the whales.

The Deepwater Horizon disaster on April 20, 2010, the worst offshore spill in U.S. history, shut down Shell?s drilling plans for the year, but barely slowed its lobbying campaign on the Arctic. In numerous White House meetings even at the height of the gulf crisis, top Shell officials pressed for a decision.

After the flow from the stricken well was stanched in July, Obama focused on when to restart offshore drilling and whether to expand it. A month before the BP disaster, the administration had proposed opening new areas to drilling off the East and Gulf Coasts as well as Alaska.

The company?s plans were set back again at the end of December 2010 when an EPA panel revoked the air pollution permit for one of its drilling rigs. The EPA action effectively stopped Shell?s plans for another year, but the president put his foot on the gas.

In May 2011, he authorized onshore oil lease sales in Alaska?s National Petroleum Reserve and extended oil companies? offshore leases in the Arctic Ocean. In July, he created by executive order a multiagency task force led by the deputy interior secretary but overseen by Heather Zichal, an environmental adviser to the 2008 Obama campaign, to prod the bureaucracy on Arctic issues, particularly Shell?s drilling plans.

Still, some government officials complained that there remained huge gaps in response plans for a spill and too many unknowns about the effect of drilling on marine animals.

At the urging of regulators, Shell strengthened spill prevention and response plans. It built a containment system for the Arctic modeled on the one that successfully capped the BP well and added ships and equipment to the armada to be in place to capture any spilled oil. The company agreed reluctantly to shorten its Chukchi Sea drilling season by 38 days, to less than three months, to ensure that the area would be ice-free in case of a blowout.

The government strengthened its Arctic research programs to better understand the impact of increased industrial activity in the northern ocean. Those and other concessions seemed to placate officials at the permitting agencies, who were navigating between their regulatory duties and the president?s obvious desire to drill.

Shell?s permits came in a rush. Interior approved exploration in both seas by last December. Response plans were endorsed in February and March of this year. The EPA?s appeals board cleared the final air permits at the end of March ? just as the whaling season got under way. NOAA came through with a marine mammal permit in early May.

?We can?t stop it,? said one senior agency official who had qualms about Arctic drilling but understood the president?s wishes. ?We can only make it less bad.?

Shell is awaiting its final drilling permits from the Interior Department. Two Shell ships are in Seattle, undergoing final modifications and inspections.

Book Review: The Wild Book by Newbery Honor-Winning Author ...

?

About the Author: Writing a historical novel in verse feels like time travel, a dreamlike blend of imagination and reality. It is an exploration. It is also a chance to communicate with the future, through young readers.

I love to write about young people who made hopeful choices in situations that seemed hopeless. My own hope is that tales of courage and compassion will ring true for youthful readers as they make their own difficult decisions in modern times.

My connection to the history ofCubais personal. My American father traveled to the island after seeing National Geographic pictures of my Cuban mother?s hometown,Trinidad. Even though they did not speak the same language, they fell in love and got married. I was born and raised in my father?s hometown ofLos Angeles,California, but we spent summers inCuba, where I developed a deep bond with my extended family. I also developed a lifelong passion for tropical nature, which led me to study agronomy and botany, along with creative writing. http://margaritaengle.com/about.html

The Wild Book by Newbery Honor-Winning Author Margarita Engle

About the Book: Fefa struggles with words. She has word blindness, or dyslexia, and the doctor says she will never read or write. Every time she tries, the letters jumble and spill off the page, leaping and hopping away like bullfrogs. How will she ever understand them? But her mother has an idea. She gives Fefa a blank book filled with clean white pages. ?Think of it as a garden,? she says. Soon Fefa starts to sprinkle words across the pages of her wild book. She lets her words sprout like seedlings, shaky at first, then growing stronger and surer with each new day. And when her family is threatened, it is what Fefa has learned from her wild book that saves them.

The Wild Book is a novel in verse inspired by stories told by Margarita?s grandmother about her childhood. The gorgeous cover is illustrated by talented multiple Pura Belpr? winning illustrator, Yuyi Morales.

?

My Review: The Wild Book is fiction inspired by stories told by the author?s grandmother Fefa, who at a young age struggled with dyslexia.? But she found ways to overcome this disability with help from her mother who gave her a book with blank pages to write down her thoughts.

Fefa wrote about how her classmates and siblings taunted her, they laugh and mock her and her brothers frighten her with lizards, bugs and spiders. The teacher was too busy to give her extra help and her mom was always there to help her. Her mother taught her to learn how to go slowly and take her time.

While Fefa was frustrated, lonely and struggling with words, she observes the uncertain world ofCuba. It was a time of lawlessness, whenCubawas terrorized by bandits kidnapping farm children unless their families agreed to deliver ransom money in advance.? She wrote about the struggles that surrounded her.

Mothers who have children suffering with dyslexia will find this book useful in teaching their child how to overcome their struggles in reading and writing. The wonderful thing about this book is that Fefa learnt how to deal with her disability by writing slowly and carefully. The reading age is 10 and up, but I will recommend that parents read this book with their children for better understand.

Advanced Prostate Cancer Drug May Help at Earlier Stage

WEDNESDAY, May 16 (HealthDay News) -- A drug approved to treat advanced prostate cancer appears to help men who have localized high-risk prostate cancer if given before surgery.

Adding Zytiga (abiraterone) to conventional hormonal treatments eliminated or nearly eliminated the prostate cancer in one-third of men with this often-lethal form, according to new research to be presented at next month's annual meeting of the American Society of Clinical Oncology (ASCO) in Chicago.

"This is one of the first -- if not the first -- study to show that you can make prostate cancer in the prostate gland itself disappear in a reproducible number of patients," ASCO official Dr. Nicholas Vogelzang said at a Wednesday press conference.

Commenting on the findings, Dr. Jay Brooks, chairman of hematology/oncology at Ochsner Health System in Baton Rouge, said, "This is exciting. It's a novel way to eliminate cancer before surgery."

However, Brooks, who was not involved in the study, cautioned that the findings were still preliminary and need further investigation.

Trying to shrink a tumor with chemotherapy and/or radiation before surgery is standard for other types of cancer, such as breast or colon, but hasn't to date shown a benefit in prostate cancer, study author Dr. Mary-Ellen Taplin, associate professor of medicine at Harvard Medical School and Dana-Farber Cancer Institute in Boston, explained at the news conference.

Localized high-risk prostate cancer, which is defined as prostate cancer in men with a prostate-specific antigen level above 20, high-grade disease (a Gleason score of 8 or more), and stage T3 disease (indicating the tumor has spread through the prostate), carries with it a poor prognosis.

Standard hormonal therapy, which stops the production of male hormones (androgens), has not been shown to be effective in this type of cancer when given before surgery. Nor has the surgery, which removes the entire prostate.

Zytiga blocks production of testosterone, which can promote the growth of prostate cancer cells, but in a different way than established hormonal treatments.

This small, phase 2 trial involved 56 men with an average age of 58, all of whom had had at least three positive biopsies for prostate cancer.

For the first three months, 27 men received the standard hormonal therapy leuprolide alone, followed by leuprolide plus Zytiga for another three months.

The remaining 29 men received the two-drug combination for the whole six months, after which all men in both groups underwent prostate surgery.

One-third of the men who had received leuprolide plus Zytiga for the entire six months saw complete or nearly complete elimination of their cancer.

By comparison, only 15 percent of men in the other group experienced these results, the investigators found.

Those who received the combination for only 12 weeks had much lower response rates.

The participants also received low doses of the steroid prednisone to prevent side effects from Zytiga, although side effects overall were minimal, said Taplin.

It's not clear at this point why some men responded to the combination therapy while others did not, and that is an area that needs to be studied, the researchers said.

"In highly select people who have this aggressive type of prostate cancer, I think this is an important area to investigate," Brooks noted. "We need to figure out which patients would potentially benefit."

According to study author Taplin, the research received some funding from Johnson & Johnson, the maker of Zytiga. She said the drug is currently U.S. Food and Drug Administration-approved for patients with advanced prostate cancer that does not respond to hormone therapy, and costs about $5,000 per month.

The data and conclusions of research presented at medical meetings should be viewed as preliminary until published in a peer-reviewed journal.

President Obama?s advantage on national security marks the first time in decades a Democratic candidate has had such an edge. DC Decoder?s Liz Marlantes explains.

That's one of the details tucked in thousands of pages of documents that were seized in last year's Navy SEAL raid.?West Point?s Center for Combating Terrorism (CTC) released a study of 17 declassified documents today, offering a window into Mr. bin Laden?s views.

The report notes that one of ?the most compelling? stories to come out of the declassified documents is bin Laden?s struggle to rein in Al Qaeda affiliates, and keep his intended message and branding on track.

?I plan to release a statement [announcing] that we are starting a new phase to correct [the mistakes] we made; in so doing, we shall reclaim, God willing, the trust of a large segment of those who lost their trust in the Jihadis,? bin Laden wrote in 2010.

The CTC report notes that though bin Laden publicly condemned the West, focusing on the repression and injustices exacted on Muslims by countries like the US, his private correspondence reveals that he was particularly pained by domestic jihadi attacks on Muslims.

His frustration may have even led bin Laden to consider rebranding his Al Qaeda movement as a whole. One letter by an unknown author suggests a list of potential names?(see English translated document?# 0000009).?Some of the proposed options are aimed at making followers of Islam feel more included in the organization.

But pithy they are not:

*?Tanthim al-Jihadi li-tawhid al-Umma wa-inkathiha, which means Jihad Organization for Unification and Rescue of the Nation,

* Tanthim al-Jihadi litahrir al-aksa wa-tawhid al-Umma, or Jihad Organization to Liberate Al-Aqsa and Unify the Nation,

* Hizb tawhid al-Umma al-Islamiya, Islamic Nation Unification Party.

Damage control was an apparent concern for the organization that has little oversight on an operational level with affiliates and those simply inspired by Al Qaeda's work. In response to a letter from Al Shabab leadership in Somalia expressing interest in identifying themselves as an Al Qaeda affiliate, bin Laden wrote, "If asked, it would be better to say there is a relationship with al-Qaida, which is simply a brotherly Islamic connection, and nothing more," according to the United Press International.

"Rather than a source of strength, [bin Laden] was burdened by what he viewed the incompetence of the 'affiliates,' including their lack of political acumen to win public support ... and their poorly planned operations which resulted in the unnecessary deaths of thousands of Muslims," reads the CTC report. Bin Laden was apparently disappointed by affiliate group ISI/AQI's arbitrary attacks on Shi?ite civilians, and warned other affiliates not to commit the same mistakes.

Bin Laden feared the frequency of civilian deaths that often occurred as ?collateral damage? in regional attacks were causing the Muslim populace to lose sympathy with the movement ??particularly when these deaths were ?exploited by the enemy,? bin Laden wrote, presumably referring to Western media and governments. He also indicated a desire to create an Al Qaeda Central, a term pulled, ironically, from Western media, to maintain greater oversight of affiliate groups.

Documents also reveal that in light of the Arab Spring ? something bin Laden viewed positively ? he wanted to focus more attention on media and outreach. In part, he hoped to rouse those who hadn?t yet rebelled against their rulers to do so, but he also acknowledged the important role media plays, as ?a [principle] element of the battle.? He expressed an interest in creating an Al Qaeda media outlet that could inform more mainstream Muslims about jihad, and perhaps spark their interest in the movement.

Plastic Logic demoes flexible color display for e-readers (video)

Plastic Logic has getting by with some eastern love since last year, when RUSNANO's $700 million investment helped the e-reader maker land its Plastic Logic 100 in Russian schools. The latest fruit of that partnership is a prototype of its first flexible color e-reader display, which delivers 4,000-plus hues at a resolution of 75 ppi. The screen contains some 1.2 million plastic transistors, and it's able to bend without distorting images thanks to a top filter and a 150-ppi display below that flex at the same rate. Skip past the break for a demo clip of the tech in action, appropriately featuring some Matryoshka dolls.
